Terms and conditions of access to this website, and all pages within.
The CPD website (hereinafter the “Site”), is the exclusive property of Central Powersports Distribution, LLC and it’s agreed contracts with the OEM Manufacturers listed within the site. The purpose of the Site is to provide information about the Central Powersports Distribution and the products it represents. Use of the Site, as well as the acquisition of materials and information contained therein are subject to the following terms and conditions on ownership and copyright, which are implicitly accepted without limitation through access to the Site.
Property Rights
The website structure, and in general all the material contained in it, which is and will remain the exclusive property of the Central Powersports Distribution, LLC is intended to be provided only and exclusively for advertising and promotional purposes. Copyrights relating to its use are subject to and protected by current applicable law. The graphic and/or figurative trademarks shown herein, whether registered or unregistered, the logos and company names are the exclusive property of the CPD and its Partners. These logos may not be used by third parties without the prior written consent of the CPD.
Limits On Use
The information contained in the Site may be transferred to users’ systems exclusively for private and personal use. Any unauthorized reproduction or use, even partial, of the content available on the Site for financial, commercial or industrial purposes is also strictly prohibited and will be prosecuted to the fullest extent of the law.
Limitation of Liability
Central Powersports Distribution will ensure the update and modification of the information in the Site but does not guarantee its completeness or accuracy. The Company reserves the right to make any changes or updates to the images, products, texts or software applications that are part of the Site at any time. The Company shall not be held liable for any technical inaccuracies or typographical errors in the information or in any materials in general found in the Site.
Access to and use of the Site presupposes that users have verified the compatibility of their systems and that the connection will not result in any malfunction of the IT systems they use. Despite any precautions taken, these applications and software programs could contain computer viruses or other harmful elements in relation to which Central Powersports Distribution holds no liability. In no event whatsoever will the CPD be liable for any losses, costs, damages of any nature or entity, whether direct or indirect, that may be incurred by users from use of the Site. CPD reserves the right to pursue in the appropriate venue any activity aimed at damaging or tampering with the Site and/or the information contained therein or that might be likely to limit the use and access of the Site.
Law and Jurisdiction
These terms and conditions are governed by South Dakota law. The Courts of the state of South Dakota shall have exclusive jurisdiction and competence over any disputes in any way connected with these conditions.
California Prop 65
In compliance with California's Safe Drinking Water and Toxic Enforcement Act of 1986, otherwise known as Proposition 65, all companies selling or distributing consumer products in or into California are required to inform consumers if using their products potentially could lead to exposure to chemicals listed by the State of California as being known to cause cancer, birth defects, or other reproductive harm. Proposition 65 has resulted in certain consumer products bearing various warning labels over the years. However, recent changes to California regulations implementing Proposition 65 will result in many more consumer products having a warning applied or having a warning statement placed near the products in a retail environment. These warnings generally consist of language drafted by the State of California for particular classes of products - such as automobiles - or for more general use by almost any product. Companies are likely to use the state-drafted language because the use of other language risks penalties for the product manufacturer or retailer if the substitute language is found insufficient. Due to these updated regulations, any products produced on or after August 30, 2018 that are sold in or into California must include a chemical exposure warning if 1) the product contains one of the nearly 900 chemicals listed by the State of California and 2) use of the product may expose the consumer to one or more of the listed chemicals in an amount sufficient to require a warning. In many instances, companies may not know if the use of their product will in fact lead to a sufficient exposure so as to require a warning under California law, and undertaking such an exposure analysis on a product by product basis often is impracticable. Therefore, out of an abundance of caution many companies will apply a warning to their product to inform consumers about the potential exposure and avoid the fines and litigation costs that a failure to warn could bring.
Changes and Updates
Central Powersports Distribution, LLC reserves the right to modify and/or update this document, as well as the conditions and methods of access and use of the Site at any time and without notice. In the event of changes to the conditions, access to the Site implies the commitment to comply with those conditions as amended.
